Opći uvjeti poslovanja

Poštovani kupci, obratite pozornost na dolje navedene uvjete. Oni reguliraju pravni odnos između Vas i pansiona Villa-Inge.

Opći uvjeti poslovanja

Ako su soba/apartman naručeni i potvrđeni ili pripremljeni u kratkom roku, smatra se da je sklopljen ugovor o smještaju. Narudžba i potvrda mogu se izvršiti usmeno, telefonski, pismo, telefaksom ili elektronički. Ako iz tehničkih razloga ili zbog roka nije ili više nije moguće formalno potvrditi navedeno, dovoljnima se smatra narudžba i priprema smještaja od strane pansiona Villa-Inge.

Cijenu ukupne rezervirane usluge smještaja druga ugovorna strana uvijek plaća unaprijed pri rezervaciji, a najkasnije pri dolasku u pansion Villa-Inge. Troškovi smještaja mogu se u mjestu pružanja usluge platiti samo gotovinom, a pri rezerviranju uplatom na račun koji je naveo pansion Villa-Inge.

Važeće cijene su ukupne bruto cijene i u njih su uračunati svi zakonom propisani porezi, naknade i davanja. U slučaju promjene stopa poreza, naknada i davanja te stvarne naplate novih poreza, naknada i davanja koji su strankama do tada bili nepoznati pansion Villa-Inge zadržava pravo na odgovarajuću prilagodbu cijena.

Ako je pansion Villa-Inge postavio ili je uzajamnim dogovorom ugovoren opcijski rok, a klijent tu opciju nije iskoristio unutar tog roka, Villa-Inge ima pravo ukinuti opcijsku rezervaciju bez posebne obavijesti. Ako je pansion Villa-Inge postavio ili je uzajamnim dogovorom ugovoren rok za avansno plaćanje ili rokovi za više obroka avansnog plaćanja, a druga ugovorna strana se tih rokova nije držala, pansion Villa-Inge nema obvezu dalje održavati rezervaciju.

Zaključivanje ugovora o smještaju obvezuje ugovorne strane tijekom cijelog ugovorenog trajanja ugovora o ispunjavanju uzajamnih obveza na sljedeće:

• obveza pansiona Villa-Inge je održavati sobu/apartman spremnom u skladu s rezervacijom;
• obveza druge ugovorne strane je platiti vrijeme (trajanje) narudžbe sobe/apartmana.

Pravno se ugovor o smještaju koji se jednom zaključi ne može više otkazati. Ako ugovorna strana naručenu sobu/apartman iz bilo kojeg razloga ne iskoristi ili iskoristi samo djelomično (storniranje, kasniji dolazak, raniji odlazak), i dalje je pravno obvezna na zahtjev platiti ugovorenu ili uobičajenu cijenu usluge za cijelo razdoblje rezervacije. Ako je rezervaciju za klijenta izvršila treća strana, naručitelj zajedno s klijentom prema Villa-Inge snosi solidarnu odgovornost.

Pansion Villa-Inge se u dobroj vjeri obvezuje da će sobe/apartmane, koji nisu iskorišteni ili su stornirani, na drugi način iznajmiti i da će u te svrhe iscrpiti sve raspoložive i prikladne mogućnosti. Ako pansion Villa-Inge uspije stornirane ili neiskorištene sobe/apartmane u cijelom razdoblju i u punoj cijeni rezervacije na drugi način iznajmiti, prestaje obveza druge ugovorne strane prema pansionu Villa-Inge. Ako pansion to bude u mogućnost učiniti samo djelomično (što se tiče noćenja ili cijene), pansion ima pravo na podmirivanje razlike u iznosu. Primici ostvareni na drugi način će se vratiti drugoj ugovornoj strani. Pansion Villa-Inge će uspjeh (100% popunjenost) ili neuspjeh iznajmljivanja drugima dokumentirati predočavanjem svojih prijava gostiju koji se po zakonu moraju predočiti hrvatskim nadležnim tijelima.

Pansion Villa-Inge ima pravo na plaćanje svih usluga prije odlaska i time zakonsko založno pravo na stvari koje je gost donio.

Za štetu koju je klijent učinio u sobama/apartmanima za vrijeme svojeg boravka klijent bez ograničenja odgovara pansionu Villa-Inge.

Rezervirane sobe/apartmani gostu stoje od 15:00 sati na raspolaganju. Na dan odlaska sobe/apartmani se moraju isprazniti do 10:00.

Nije moguće rezervirati određenu sobu ili apartman. Gost može odabrati kategoriju smještaja prilikom rezervacije. Pansion Villa-Inge izričito zadržava pravo izbora sobe ili apartmana u odabranoj kategoriji smještaja do dana dolaska. Sniženje cijene rezervacije ili zahtjevi za naknadu štete su u tom pogledu isključeni.

Dogovori koji odstupaju od navedenog kao što su rokovi za odustajanje bez ili sa smanjenim troškovima, potraživanja avansnog plaćanja, uređivanje opcija, plaćanje putem bariranog čeka ili odgođenog plaćanja su mogući, ali potrebno ih je sklopiti u pisanom obliku i stupaju na snagu tek nakon pristanka pansiona Villa-Inge.

Za dovođenje kućnih ljubimaca potreban je pristanak pansiona Villa-Inge. Klijent je obvezan unaprijed najaviti želju da dovede jednog ili više ljubimaca. Ako pansion Villa-Inge da svoj pristanak za dovođenje kućnih ljubimaca, daje ga pod uvjetom da kućni ljubimci budu pod stalnim nadzorom gosta te da nemaju bolesti i ne predstavljaju opasnost za goste i osoblje. Dozvoljena su najviše dva kućna ljubimca po sobi. Dovođenje životinje/životinja na doručak nije dozvoljeno. Po ljubimcu i noćenju naplaćuje se naknada u skladu s cjenikom. Iznimka su međutim psi za slijepe, gluhe i drugi psi pomagači. Oni se mogu dovesti besplatno i u svako vrijeme u pansion Villa-Inge.

Pansion Villa-Inge čini sve kako bi što savjesnije ispunjavao narudžbe buđenja, ali ne odgovara za štetu nastalu zbog neispunjenih narudžbi buđenja ili narudžbi buđenja ispunjenih u pogrešno vrijeme.

S poštanskim pošiljkama te pošiljkama stvari i robe koje su namijenjene uručivanju klijentu na ruke se postupa s najvećom pažnjom i povjerljivošću. Pansion Villa-Inge preuzima čuvanje, internu dostavu i po želji uz naknadu naknadno slanje istih.

Povredom dužnosti prema pansionu Villa-Inge smatra se jednakom kao i povreda dužnosti prema njegovim zakonskim zastupnicima, namještenicima ili pomoćnicima. Dalekosežniji zahtjevi za nadoknadu štete isključeni su ako nisu na drugi način regulirani u ovim Općim uvjetima poslovanja.

Ako dođe do smetnji ili nedostataka na uslugama pansiona Villa-Inge, pansion Villa-Ingeće se po obavijesti ili neposrednoj žalbi gosta potruditi sanirati iste. Gost je obvezan uložiti razuman napor u doprinos otklanjanju smetnje i što je moguće većem smanjivanju moguće štete. Ostale obveze gosta su pravovremeno ukazivanje pansionu Villa-Inge Inge na mogućnost nastajanja iznimno visoke štete.

Za donesene stvari pansion Villa-Inge odgovara prema zakonskim odredbama koje ograničavaju odgovornost na iznos od najviše 1.000,00 €, a za novac, vrijednosne papire i dragocjenosti na iznos od najviše 750,00 €. Klijent gubi ovo pravo ako odmah nakon što uoči gubitak, uništenje ili oštećenje donesenih stvari o tome ne obavijesti pansion Villa-Inge. Za neograničenu odgovornost vrijede zakonske odredbe.

Ako se klijentu na zemljištu pansiona na raspolaganje stavi parkirno mjesto, čak i uz naknadu, time nastaje ugovor o ostavi (čuvanju). Pansion Villa-Inge nema obvezu održavanja nadzora nad parkirnim mjestom. Pansion Villa-Inge snosi odgovornost samo u okviru kaznene odgovornosti. Pansion Villa-Inge ne odgovara za štete za koje moraju odgovarati samo drugi klijenti ili ostale treće osobe. Eventualna šteta mora se prijaviti pansionu Villa-Inge prije napuštanja zemljišta.

Ako jedna ili više odredbi ovih Općih uvjeta poslovanja postane neučinkovita, to neće utjecati na učinkovitost ostalih odredbi. Strane će neučinkovite odredbe bez odgode zamijeniti učinkovitima, a koje će neučinkovitim odredbama po smislu biti što sličnije.

Sudska nadležnost je mjesto obavljanja poslovne djelatnosti kao mjesto pružanja usluge i time Opatija (Mošćenička Draga), Hrvatska. Bilo kakvi poslovni uvjeti klijenta/druge ugovorne strane se ne priznaju. Primjenjuje se isključivo hrvatsko pravo.

Ovi Opći uvjeti poslovanja vrijede za sve pravne poslove sklopljene od ovog trenutka.
